Забезпечення виконання договору про закупівлю
Забезпечення виконання договору про закупівлю повертається: 1) після виконання переможцем процедури закупівлі/спрощеної закупівлі договору про закупівлю; 2) за рішенням суду щодо повернення забезпечення договору у випадку визнання результатів процедури закупівлі/спрощеної закупівлі недійсними або договору про закупівлю нікчемним; 3) у випадках, передбачених статтею 43 цього Закону; 4) згідно з умовами, зазначеними в договорі про закупівлю, але не пізніше ніж протягом п’яти банківських днів з дня настання зазначених обставин

The Performance security shall be denominated in the currencies of the Contract, in accordance with their portions of the Contract Price.
Performance security shall be provided by reputable banking institution from any eligible country.
The bank guarantee issued by the Ukrainian or foreign bank must be advised according to the provisions of the Uniform Rules for Demand Guarantees (2010 edition) ICC Publication No. 758 by the Purchaser` bank (JSC Ukreximbank, Ukraine, BIC: EXBSUAUX).
All banking charges and fees related to the bank guarantee shall be at Supplier’s account.
The Performance Security of a Joint Venture or Association shall be in the name of all the partners of the JV or Association that signed the Contract.
